Exclusive! Farrah's producing partner on Emmy loss: "We didn't deserve to win!"

If only to recognize Farrah Fawcett for her contribution to television culture and American history, it would have been nice to see the disputed NBC special, Farrah's Story, win the Emmy for Outstanding Nonfiction Special at last night's creative arts awards ceremony. The loss was a blow to fans and friends, but not to Farrah's business and producing partner Craig Nevius, who produced the basis for the special with Farrah before she was weakened by cancer and he was edged out by her lover and caretaker Ryan O'Neal. Nevius sent Tabloid Baby this exclusive reaction:

In terms of Farrah's Story not winning: I have mixed emotions about it. I would have liked for Farrah to have been be honored her bravery, honesty and artistry-- not only in fighting this disease but in fighting it on camera in front of the whole world. But I can't lie and say the final product deserved to win.

As most everybody knows by now, the documentary was never finished (at least not if it was really Farrah's story). I was thinking about this on the way home last night. And I remembered a conversation I had with Farrah about her art. I asked her why she had so many unfinished paintings and sculptures. She explained that her art was like her life. It was always evolving and getting a little more interesting. That's why it needed to stay unfinished (for as long as it possibly could). I think my point is that Farrah wanted to surprise herself. She wanted to go to places that most other people, including herself, had never been before. Or even knew existed.

Like when we were in New York (shooting Chasing Farrah). We wrapped up a little early one afternoon and Farrah wanted to take advantage of the opportunity to go to the Empire State Building. That was the one thing that she had never had time to do on any previous trip to NYC. I told her that I would go with her. A few people from the crew came along -- including her old friend (and hair stylist) Mela Murphy as well as a new friend (and photographer) Lisa Boyle.

What was interesting about the trip was that Farrah immediately lost interest in the view from the 86th floor observatory where everyone else stood in awe of the skyline. That's because one of the security guards told us that there was an even higher vantage point in the building but the public wasn't allowed up there because it was a little bit dangerous. Well, that's all Farrah needed to hear. The fact that it was 'not allowed' and 'a little bit dangerous' made it all the more worth doing for her.


So we all went up to the 'tower attic.' It was like being inside a lighthouse that was still under construction. Except the floor was nothing but a metal construction grill that allowed you to see past your feet at a several story drop back down to the 86th floor. Actually, not all of us went up with Farrah. Mela wouldn't get out of the elevator. Lisa wouldn't even get in the elevator. This made it even more fun for Farrah who took delight in calling them both 'Fraidy cats!' She loved it.


I remember her giggling as she tested the sturdiness of the grill by hopping up and down on it like a kid on a new mattress. The view from the tower was so amazing that Farrah had to call her father to describe the sunset to him. Before we left Farrah noticed one of the tower walls: some construction workers and maintenance men had graffitied it. Well, Farrah didn't want to go without leaving her mark. I never forgot what she wrote.


Even though it sounded like a cliche I knew that it was more than that. I just didn't know what the deeper or more symbolic meaning was-- at least not at the time.

It didn't matter to Farrah that most people would never see her name on that wall. Or even know that she was ever there. Because she knew. And she was proud of it.

It's a little bit like that with her documentary.

While Farrah Fawcett may win her first Emmy tomorrow night, her producing partner has already won a round in his court fight against Ryan O'Neal

Farrah Fawcett may finally win an Emmy on Saturday night, an award that's eluded her in three previous nominations in as many decades (The Burning Bed, Small Sacrifices & The Guardian). Should she win posthumously for the controversial Farrah's Story, the statuette won't be for her acting, but for her role as executive producer of the documentary she made chronicling her fight with cancer.

Meanwhile, Craig Nevius, Farrah's fellow producing nominee, is only beginning his own fight: a legal war with Ryan O'Neal over who has the right to tell Farrah's real story. Nevius and Farrah worked for almost two years on an unconventional yet inspirational "video diary" that would tell Farrah's story from her point of view. Yet, after Farrah sold the material to NBC and her health took a turn for the worse in April, she turned her affairs over to longtime lover O'Neal, who took control of the documentary, kicked Nevius to the curb and rejigged it with the help of NBC Dateline into an exploitation of a celebrity's death with a nod to his own film, Love Story.


Nevius filed a lawsuit against O'Neal, his business manager Richard Francis, and Alana Stewart, Farrah's friend who helped shoot some of the documentary footage and later held out for producing credit that has her up for an Emmy as well.

The lawsuit was in court this week. A Tabloid Baby contributor was there and sends us this unsolicited report:

"After Craig Nevius filed suit, O'Neal and Francis responded quickly and in full force by retaining the very prestigious and very powerful law firm of Mitchell, Silberberg & Knupp to defend them against Nevius' claims, which the world-class attorneys characterized in court papers as "meritless," "frivolous" and "ludicrous."

Attorneys Kim Swartz and Karin Pagnanelli of MSK also attempted to minimize if not completely deny Nevius' true contribution to the documentary and his position in the company that he and Farrah had formed to own and license the the documentary worldwide (Sweetened By Risk LLC).

Nevius filed a motion to disqualify Swartz, Pagnanelli and their 100-year old law firm for conflict of interest. He claims that MSK had previously represented him as a producer as well an owner and member of Sweetened By Risk LLC (with Farrah).


Swartz, Pagnanelli and MSK have denied that any such attorney-client relationship existed and produced an alternative SBR LLC Operating Agreement dated June 5, 2008 (approximately eight weeks after Farrah and Nevius signed the April 1, 2008 Operating Agreement). This "renewal" agreement appears to have been unilaterally executed by Farrah, and contains a scrawled signature that's identical to the disputed signature from the April 20th, 2009 "Delegation of Authority" (to Ryan O'Neal and his business manager Richard Francis).

MSK seemed to be painting Nevius as a disgruntled employee who was angry at Farrah (for some unspecified reason) and was sought ownership and/or control of the documentary and SBR LLC out of revenge.

At a hearing on September 1st, MSK sent in a "big gun": managing partner Thomas P. Lambert appeared in court to make arguments against the disqualification of Mitchell, Silberberg & Knupp over a dispute in a two person LLC with only one asset.

Across the table from Lambert and company was a single lawyer representing Nevius: Miles Feldman of Liner, Grode, Stein, Yankelevitz, Sunshine, Regenstreif & Taylor LLP.

The lone attorney was enough, as Judge Joseph S. Biderman granted Nevius' motion for the disqualification (the "tentative ruling" has since been made official).

Judge Biderman agreed with Nevius' attorney that the case is a dispute about ownership and control of SBR and the film. Therefore there was conflict of interest for the company's attorneys (Swartz and Pagnanelli et al) who would likely be called as witnesses over the various agreements and delegations that they allegedly drew up.

As a result Judge Biderman's ruling, O'Neal and Francis must now retain new, unbiased representation or formally appeal the motion in the hopes that the ruling will be overturned.

Nevius was seen in the courtroom.

None of the defendants was present.

Both the plaintiff and the defendants, however, are expected to be at the Nokia Theatre in downtown Los Angeles on Saturday night for the Creative Arts Emmy Awards. Farrah's Story is the favorite to win the Emmy for Outstanding Nonfiction Special.

As Nevius said in his recent interview with Retroality.tv's Chris Mann: "The fact that this documentary touched so many people (and received an Emmy nomination) is a real tribute to Farrah. It succeeded in reaching people in spite of everything that Ryan and Alana did to it (and tried to do to it). Because at the end of the day, Farrah was still Farrah.""

No fluke: Canceled Cristina's Court wins second Daytime Emmy for Outstanding Courtroom Program

Cristina's Court has won the Emmy award for Outstanding Legal/Courtroom Program for the second year in a row.

The show starring Cristina Perez and produced by (tabloid) television legend Peter Brennan picked up the statuette last night at a ceremony at the Bonaventure Hotel in Los Angeles.

Cristina's Court stunned the television world when it picked up the first-ever Emmy Award for Outstanding Legal/Courtroom Program a year ago. That win was the biggest news to come from last year's Emmy Awards, because it was the first court show Emmy, and generally assumed to have been created in order to give Judge Judy a prize.

Last night's announcement proved that Cristina's Court's first Courtroom Program Emmy was no fluke. The win was suspected a few weeks ago when the Emmy producers decided-- after the votes were counted-- to remove the popular category from tonight's televised awards show and stick it with the the technical awards that were handed out hours ago.

The second Emmy does come with bittersweet cheer. The Fox Television Stations Group canceled Cristina's Court in February to make room for a court show featuring Republican politician Jeanine Pirro, which had been running to lower ratings on Fox's CW Daytime lineup. Republican adviser and Fox News president Roger Ailes is also chairman of the Fox Stations Group.

Cristina's executive producer Peter Brennan, who created the tabloid television genre with A Current Affair, was the original producer of Judge Judy.

Farrah's Story cops Emmy nomination

It's one of those best-of-times-worst-of-times mornings for producer Craig Nevius. He and Farrah Fawcett spent years working on the documentary about her travels in search of a cure for her cancer. Then Farrah sold the project to NBC, and when her condition worsened, her boyfriend Ryan O'Neal took control of the project, pushing Nevius out and alowing producers from NBC's Dateline to re-edit and reshoot the nonfiction film into a maudlin, morbid death march.

But Craig Nevius managed to retain his executive producer title.

This morning, the Academy of Television Arts & Sciences announced that "Farrah's Story" has been nominated for an Emmy for Outstanding Nonfiction Special. So along with NBC's Alexandra Gleysteen and Robert Dean, Craig Nevius is an Emmy nominee.

And so is Farrah, with a posthumous producing nomination (she'd had acting nods for The Burning Bed, Small Sacrfices and The Guardian).

It's all good for Alana Stewart. Farrah's companion on her trips to Germany, who often held the home video camera, not only was first out of the gate with a book deal, she held out at the end for more money and producer's credit. She, too, is an Emmy nominee.

Cristina's Revenge! Second nomination for canceled Emmy-winning courtroom show

Cristina's Court and its star Cristina Perez won the first-ever Daytime Emmy Award for Outstanding Legal/Courtroom Program last year, even though the category was created so Judge Judy would get a statuette and the hot blonde Cristina's program was only in its second season. Fox stations group boss Roger Ailes rewarded Cristina and crew by canceling the show with the intention of replacing her with a scandalized Republican party political hack who was doing half the ratings with a court show on the CW but also did his bidding on his Fox News and sought the nomination to run for Senate against Hillary Clinton.

Tonight, Cristina's got her revenge, with a second Emmy nomination.

Boston blogsite defends Barry Nolan

Former tabloid television host Barry Nolan was fired from his job as a cable show co-host this week over a loud and passionate campaign to deny his former tabloid television rival Bill O'Reilly a Boston Emmy. Comcast isn't commenting, so it's not clear whether the cable television giant fired him for simply speaking out against a cable television superstar or because Barry spun out of control with liberal furor (his campaign included over-the-top name-calling-- labelling O'Reilly a "mental case"-- mass emailing of Academy members-- a personal attack on Tabloid Baby's editor for questioning the wisdom of his outburst-- Barry snarkily accused him of being sober, nasty shots at Tabloid Baby commenters who disagreed with him, and ultimately, the old-school propaganda tactic of leafleting the Emmy ceremony with quotes from O"Reilly and the "loofah-falafel" sex harassment suit that O'Reilly somehow overcame), but what has been most striking is the lack of public support for Barry.

Well, at least one Bostoncentric blogsite has joined us in challenging the firing (we've got no hard feelings-- we encourage the traditional literary feud). The Bostonist, part of The Gothamist group, stands tall:

Comcast Bows to O'Reilly, Fires Barry Nolan

For a while, it seemed safe to have opinions about overprotected, pasty professional jaw-flapper Bill O'Reilly. Stephen Colbert won awards for it. But local CN8 host Barry Nolan from "Backstage" just got canned for it.

Nolan protested the fact that the New England EMMY chapter honored O'Reilly and handed out flyers at the event. However, he didn't give that opinion on the air or even spoof O'Reilly a la Colbert. Nolan said that, when O'Reilly was honored by the EMMY chapter, other people booed. Will all of them be fired, too, for sharing their opinions off the clock?

This is sad. Bostonist fondly remembers when Nolan interviewed Slavoj Zizek, a professional jaw-flapper who seems far less uptight than O'Reilly.

So what did the New England chapter of the National Academy of Television Arts & Sciences have to do with cable television monolith Comcast's to fire former tabloid television host Barry Nolan from his hosting gig on its CN8 variety network, in response to his bitter and very personal campaign to stop the group from giving a special Emmy award to Bill O’Reilly?

Barry’s attack was not only on O’Reilly but on the wisdom of the local Emmy group’s decision to honor Barry’s former tabloid television rival and current cable news superstar. Though Barry did not speak up during the awards ceremony on May 10th, according to the Boston Herald he apparently disrupt the event by putting fliers on tables containing "quotes from O’Reilly as well as three pages from the sexual harassment lawsuit O’Reilly settled.

“Security approached Nolan and told him he couldn’t distribute information at the event.”

He'd also waged an email campaign asking Academy members to challenge the chapter's decision.

We asked Tim Egan, the president of the New England chapter of NATAS if his group, or the incident at the awards ceremony had anything to do with Barry’s firing.

He replied:

“The National Academy of Television Arts & Science does not comment on station operations.”

Little sympathy for Barry in Boston

Yeah, he got his wish and now he's a liberal martyr and once again elevated near the recognition level of his former tabloid television rival Bill O'Reilly. And even though he attacked us amid his fateful O'Reilly offensive, we're the first to say it:

Boy, do we feel sorry for Barry Nolan!

After leaving Hollywood and the tabloid world for the rarified and certainly liberal Boston television market, with knowledge of enough twenty-five cent words to get himself a spot on a National Public Radio-style word quiz show, and enough wit and boyish good looks (not to mention that Mensa card) to marry a respected local documentary producer and academic, surely he felt safe-- and, perhaps, duty-bound-- speaking up against a ticket-selling ploy by the local branch of the National Academy of Television and Sciences (SATAN in reverse, by the way) of offering his former tabloid television rival Bill O'Reilly a special Emmy.

But Barry's campaign got him fired from his job hosting a show for Comcast's cable system. Whether there's more to it than the fact that he spoke his mind (as Barry's related scattershot attack on this site might indicate), we'll find out, but in the meantime, public opinion was definitely not in his favor, as evidenced by the reaction to the Boston Herald tabloid's stories of his campaign-- and its repercussions.

Barry misjudged his audience-- something his mentors back in the halcyon (Peter Brennan) days of Hard Copy would not have done. Maybe he should have gone to the more liberal Globe, where he'd have a better chance of controlling the spin. But tabloid is as tabloid does.

"He's a man that mangles the facts." Do they actually believe that O'Leilly does not mangle the facts? My WWE comparison stands in the matter of Bill O'Reilly. The guy's doing schtick, an act, whatever you want to call it. Somebody once said he'd rather "be loud than right" and there's the problem. A guy like John McLaughlin is bombastic and over-the-top, but regardless of the opinion, you have to admit he's entertaining. So much so that when Dana Carvey started lampooning him, the bit absolutely went to Carvey's top five. O'Reilly on the other hand, is just a mean-spirited blowhard who just happens to be an idiot on top of it. Check out his repeated references back in an '05 series of debates/discussions with Gen. Wesley Clarke to a massacre of German prisoner/soldiers by American troops at Malmedy, Belgium during WWII. Of course it just happened to be the other way around. German soldiers murdered unarmed American POWs who had their hands in the air. Hey, why let the facts get in the way of a good rant? It doesn't matter that Barry Nolan is a nobody in Bill's world. O'Reilly is deserving of honor from no one.

It appears that former tabloid television host Barry Nolan's big protest over Bill O'Reilly's Emmy honor in Boston ended in a big gala tuxedoed whimper. You'll recall that that Barry got himself in the papers by shouting that O'Reilly didn't deserve the award because he was a "mental case" (and-- let's cut through the BS-- a conservative) and threatened to disrupt the awards show by bringing real-life mental case Keith Olbermann as his "date" (and you'll recall that after we suggested that our former colleague Barry "get a grip," he responded by attacking our readers, the memory of actor David Dukes and possibly libelling our own Burt Kearns by suggesting he was "sober"). The "mainstream media" didn't follow up on Barry's initial publicity-seeking gasblast, so today we got in touch with the New England branch of the National Academy of Television Arts & Sciences.

Its president was gracious enough to respond:

"Bill O'Reilly was presented the 2008 Governor's Award. His speech was about his ties to New England and what he learned in TV here. He was humble and gracious. And he was well received by the audience. Barry Nolan attended, Keith Olbermann did not.

Bill O’Reilly, Lt. Governor Tim Murray, Kelley Tuthill and Gary Gulman provide a show for the ages

The Boston/ New England Chapter of the National Academy of Television Arts and Sciences (NATAS) celebrated its 31st Boston/New England Emmy Awards Gala on Saturday Night May 10th at the Marriott Copley Place. WCVB and WBZ grabbed the most statuettes with 10 each, followed by WFXT with 8, WHDH and NESN which took home 5 each, WGBH with 4 and WJAR, WTNH, WTIC, WPXT, CN8 which collected 3 each. Twenty two different stations were given awards and seventeen stations got to the stage multiple times, demonstrating the enormous amount of journalistic and creative talent working in broadcast media throughout New England. In total, NATAS presented 68 awards, selected among 788 entries from 37 stations; each a record number.

The evening’s centerpiece was the presentation of the prestigious Governor’s Award. This year’s award was given to Bill O’Reilly who was effusive in his thanks and praise for the city and market. During his remarks, the nation’s highest rated cable news host called Boston, “by far the best local news market in the country” adding that working at the Phoenix, attending BU and Harvard and anchoring both channels 5 & 7 had “made him what he is today.”

"What a phenomenal night!” said NATAS Chapter President Timothy T. Egan welcoming Lt. Governor Tim Murray to the stage to serve as a surprise presenter. “We are celebrating the best of the industry and this is the one night each year when you realize the absolute wealth of talent that lives and works in New England."

First time host Gary Gulman made a very auspicious debut. The Peabody native and former BC football player turned Leno and Letterman comic favorite kept the audience entertained throughout the evening...
